A BILL

for

AN ACT relating to electrical
generation and
transmission; providing for a study of the electrical industry in this state as specified; requiring a report; providing an appropriation; and providing for an effective date.

Be It Enacted by the Legislature of the State of
Wyoming
:

Section 1.

(a)

The
University
of
Wyoming
School of
Energy
Resources shall conduct

a
study of the electrical industry in
the state of
Wyoming
and the surrounding region. The study shall:

(i)

Review Wyoming's current electrical production capacity and estimate any changes in that capacity which may occur as the result of new technologies or by developing alternate electric sources including solar, wind and geothermal sources
;

(ii)

Review
Wyoming
's projected needs for future interstate and intrastate electrical generation transmission;

(i
i
i)

Review the volume of in-state and interstate use of electricity and the generation capacity of electricity in this state in light of the amount of electricity that is exported from this state;

(i
v
)

Review the economic impacts of:

(A)

The number of jobs that are generated by the construction of electrical generation facilities in this state during and after construction;

(B)

The amount of ad valorem property taxes paid by electrical generation companies and the entire electrical generation industry in this state;

(C)

The amount of taxes paid regionally and the amount of taxes received by this state;

(D)

The potential impact of an electrical generation tax.

(v)

Review the possibility of new development and the impacts of that development on land, air and water quality;

(v

)

Review the potential impact that eminent domain may have on electrical generation facility development including land currently acquired by eminent domain and the potential land to be acquired for new electrical generation;

(vi
i
)

Contain a
n analysis of value added return on new electrical transmission in light of the potential exportation of electricity from this state.

(b)

The department of revenue shall provide any necessary administrative support for the study required by subsection (a) of this section.

(c)

Following completion of the study, a report shall be submitted to the joint minerals, business and economic development and the joint revenue interim committees not later than December 1, 200

Section 2.

(a)

There is appropriated
two hundred fifty thousand dollars ($250,000.00) from the general fund to the University of Wyoming School of Energy Resource
s
. This appropriation shall be for the period beginning with the effective date of this act and ending June 30, 2009.

(b)

This appropriation shall only be expended for the
purpose
of completing the study required by this act. Notwithstanding any other provision of law, this appropriation shall not be transferred or expended for any other purpose and any unexpended, unobligated funds remaining from this appropriation shall revert as provided by law on June 30, 2009.

(c)

This appropriation shall not be included in the
University
of
Wyoming
's standard biennial budget request.
