WORKING DRAFT 2009 STATE OF WYOMING 09LSO-0209 HOUSE BILL NO. HB0013 Subdivision fences-2. Sponsored by: Joint Agriculture, State and Public Lands and Water Resources Interim Committee A BILL for AN ACT relating to subdivisions; requiring arrangements for partition fences as specified; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section 1. W.S. 18 ‑ 5 ‑ 306(a) by creating a new paragraph (xii) is amended to read: 18 ‑ 5 ‑ 306. Minimum requirements for subdivision permits. (a) The board shall require the following information to be submitted with each application for a subdivision permit, provided the board may by rule exempt from any of the following requirements of this subsection or subsection (c) of this section the subdivision of one (1) or more units of land into not more than a total of five (5) units of land: (xii ) Evidence satisfactory to the board that: (A) The subdivider or his agent who offers any part of the subdivision for sale or who solicits any offers for the purchase thereof, has discussed partition fences with all adjoining landowners; (B) Binding arrangements have been made with the subdivider and all adjoining landowners regarding erection of partition fences between the subdivision and all adjoining landowners. If a partition fence is to be erected the arrangement shall provide when the partition fence shall be completed; and ( C ) A determination has been made as to whether each purchaser or the subdivider is responsible for erecting the partition fence between each purchaser and all adjoining subdivision parcels and when the partition fence for each parcel shall be completed. Section 2. This act is effective July 1, 2009. (END) 1 HB0013
