Funds generated by the lease of lands.

(a)

Monies generated by the lease
for grazing
of lands owned in fee by the military department and which are not state lands as defined in W.S. 36
‑

‑
101(a)(iv),
may be
utilized
by the military department for the operatio
n and maintenance of such lands. Funds collected from these
grazing
leases shall be deposited in a special account created to receive such funds, shall be continuously appropriated to the department and expended solely for the purposes specified in this section.

(b)

At the end of each fiscal year, after the purposes provided in subsection (a) of this section have been fully funded from the annual grazing lease proceeds, remaining funds shall be deposited to a special reserve account. Eighty percent (80%) of the funds within the special reserve account may be expended in subsequent fiscal years for the department's general operations and, subject to the limitation of this subsection, twenty percent (20%) shall be retained and expended only for emergency contingencies, as declared by the governor, for operations and maintenance of the lands leased under subsection (a) of this section. At any time restricted emergency funds in the reserve account equal the annual average of gross grazing lease receipts for the prior three (3) years, all other funds within the reserve account or to be deposited to the reserve account may be used for the department's general operations. Funds within the reserve account are continuously appropriated for purposes of this subsection.

(c)

The department shall annually report to the joint transportation, highways and military affairs interim committee the monies generated under subsection (a) of this section and how those monies were expended by the department
.

Section 2.

This act is effective July 1, 2009.
