Summary/Major Elements:

The act creates the national guard health care provider
retention program, which pays a portion of medical malpractice insurance
premiums for health care providers who serve in the national guard. The act:

Provides a
one-time reimbursement for medical malpractice premiums paid by a qualifying
health care provider who, after July 1, 2009, enters into a 2 year or 4 year
service contract with the Guard.

For health
care providers signing a 2 year service contract, the maximum benefit is 50% of
the total cost of malpractice insurance premiums paid during the most recent
calendar year in the term of the initial service contract, and in no event more
than $15,000.00.

For health
care providers signing a 4 year service contract, the maximum benefit is 100%
of the total cost of malpractice insurance premiums paid during the most recent
calendar year in the term of the initial service contract, and in no event more
than $30,000.00.

The premium
is paid directly to the insurer and applied toward the health care provider's malpractice
insurance at the execution of their service contract.

To be
eligible to participate, a health care provider must be:

A Wyoming resident.

A physician,
dentist or optometrist licensed to practice in Wyoming and currently an officer
in good standing, or fulfilling the requirements to become an officer.

Requires
repayment of benefits received if the medical professional ceases to be
qualified. The adjutant general may promulgate rules waiving or suspending
repayment obligations.

Creates the
national guard health care provider retention account.

Appropriates
funds to operate the program.
