Summary/Major Elements:

The
budget bill in 2008 required the game and fish commission to develop
rules, regulations and procedures to allow private bird farms in this
state to raise native sage grouse for release.

This act follows up on that
provision by requiring the commission to report to the travel, recreation,
wildlife and cultural resources committee by August 31, 2009 regarding those
rules.

It also prohibits the rearing
and release of native sage grouse under a private game bird license until
authorized by legislation enacted after April 1, 2009; i.e., until after the
next scheduled legislative session.

Comments:

The
2008 budget bill footnote requiring the game and fish commission to develop
rules allowing for private bird farms to raise native sage grouse for release
was amended in the 2009 budget bill to instead require the game and fish
department to report to the travel, recreation, wildlife and cultural resources
committee by October 1, 2009 on the latest research regarding artificial
propagation of sage grouse and make a recommendation regarding the feasibility
of captive breeding of sage grouse.

Be It Enacted by the Legislature of the State of
Wyoming
:

Section 1.

The game and fish commission and department shall report to the joint travel, recreation
,
wildlife
and cultural resources
interim committee not later than August 31, 2009 regarding
the
development of
commission
rules, regulations and procedures
pursuant to
2008 Wyoming Session Laws,
c
hapter 48,
s
ection 2,
s
ection 40, footnote 3
,

to allow private
game
bird farms

in this state to raise native sage grouse for release
. The
committee
may
sponsor legislation in the 2010 budget session as it determines appropriate to address the issue of private game bird farms raising native sage grouse
for release
.

Neither the raising nor release of native sage grouse shall be permitted under any game bird farm license issued under W.S. 23

‑
102 unless specifically authorized by legislation enacted after April 1, 2009.

Section 2.

This act is effective immediately upon co
m
pletion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constit

tion.
