Sponsored by: Representative(s) Teeters and Senator(s) Sessions A BILL for AN ACT relating to motor vehicles; providing for the issuance of a citation to the owner of a vehicle observed passing a school bus as specified ; providing a penalty; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section 1 . W.S. 31 ‑ 5 ‑ 507(e) and (f) is created to read: 31 ‑ 5 ‑ 507. Meeting or passing stopped school bus; markings and visual signals. (e) On the basis of information supplied by a school bus driver, school administrator or school district personnel containing the basic description of the vehicle and driver, the license plate number of the vehicle involved in an alleged violation of subsection (a) of this section, and the time and approximate location of the alleged violation, a peace officer may issue a citation for the alleged violation to the owner of the vehicle. Information provided pursuant to this subsection may serve as probable cause to issue a citation for the purposes of W.S. 7 ‑ 2 ‑ 103(a) and creates a rebuttable presumption that the owner of the vehicle was the driver of the vehicle at the time the alleged violation of subsection (a) of this section was observed. (f) Any person violating subsection (a) of this section is guilty of a misdemeanor and upon conviction shall be punished as provided in W.S. 31 ‑ 5 ‑ 1201(e). Section 2. This act is effective July 1, 2009. (END) 1 HB0107
