Sponsored by: Representative(s) Teeters, Brechtel and Stubson and Senator(s) Perkins A BILL for AN ACT relating to school districts; providing for equal assessment of activities participation fees upon students ; reimbursing districts for payment of participation fees; imposing duties upon the department of education; providing an appropriation; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section 1. W.S. 21 ‑ 4 ‑ 506 (a)(i) is amended to read: 21 ‑ 4 ‑ 506. Participation in activities by students not enrolled in the district; limitation on fees. (a) Any school age child who is a resident of a school district, who is not under suspension or expulsion by a Wyoming school district and who is not enrolled as a full-time student in the district in which he resides, shall be permitted by the district to participate in any activities which are sanctioned by the Wyoming high school activities association and which are offered by the district subject to the following: (i) The district may require the student to pay any fees for participation which are required by the Wyoming high school activities association provided any such fees imposed under this paragraph are equally imposed upon all students within the district ; Section 2. (a) Ten thousand dollars ($10,000.00) is appropriated from the public school foundation program account to the department of education for distribution to school districts for reimbursement of amounts paid for participation fees imposed by the Wyoming high school activities association on behalf of those resident children enrolled less than full time in the district and participating in district activities pursuant to W.S. 21 ‑ 4 ‑ 506. (b) On or before August 15, 2009, t he department shall notify each district of reimbursements available under this section and shall request each district to report participation fee payments made under W.S. 21 ‑ 4 ‑ 506(a)(i), as amended under section 1 of this act, to the department by October 1, 2009. Reimbursements under this section shall be made by the department to eligible districts not later than November 1, 2009. (c) Th e appropriation under subsection (a) of this section shall be for the period beginning July 1, 2009, and ending June 30, 2010. Section 3 . This act is effective July 1, 2009. (END) 1 HB0108
