Summary/Major Elements:

The Recreation Safety Act,
W.S. 1-1-122 through 1-1-123, provides generally that persons engaged in sport
and recreational opportunities assume the risk of injury from risks inherent in
the activity. W.S. 34-19-104 provides that landowners owe no duty of care to
persons using their land for recreational purposes.

This act expands the
definition of "sport or recreational opportunity" under the
Recreation Safety Act to include the use of private land for vehicle parking
and access related to sport or recreational use of the land. This act also
extends landowner protection to include parking and access under an easement
granted to the state or subdivision of the state for recreational purposes.

Definitions.

(a)

As used in this act:

(iii)

"Sport or recreational opportunity" means commonly understood sporting activities including baseball, softball, football, soccer, basketball, swimming, hockey, dude ranching, nordic or alpine skiing, mountain climbing, river floating, hunting, fishing, backcountry trips, horseback riding and any other equine activity, snowmobiling and similar recreational opportunities

and includes the use of private lands for vehicle parking and land access related to the sport or recreational opportunity

Application to land leased to state or political subdivision thereof.

(a)

Unless otherwise agreed in writing W.S. 34

103 shall be deemed applicable to the duties and liability of
:

(i)

A
n owner of land leased to the state or any subdivision of this state for recreational purposes
;

(ii)

An owner of land on which the state or any subdivision of the state has an easement for vehicle parking and land access for recreational purposes.

Section 2.

This act is effective July 1, 2009.
