AN ACT relating to public health and safety;
amending
reporting requirements relating to abortions; providing a penalty; and providing for an effective date.

Forms for reporting abortions.

(a)

The state office of vital records services shall establish an abortion reporting form which shall be used
after May 27, 1977
for the reporting of every abortion performed or prescribed in this state
, including medical abortions performed by administration of an abortifacient drug
, which for purposes of this section includes any drug administered with the intent to terminate a known pregnancy but does not include any drug administered prophylactically for purposes of birth control
. The form shall include the following items in addition to such other information as may be necessary to complete the form, but in no case shall information be required that would tend to disclose the identity of any
patient or other
individual participating in an abortion:

(i)

The age
and county of residence

of the pregnant woman;

(iii)

A complete description of

c
omplications, if any;

(vii)

The general reason for the abortion including whether it was performed as a result of a pregnancy occurring from sexual assault;

The county of occurrence for
the
abortion
.

(c)

Any person who fails to file a report required by this section is guilty of a misdemeanor punishable by a fine of
two
hundred dollars ($

Compilations of abortions; matter of record; exception; reports.

(a)

The
state office of vital records services shall prepare and after May 27, 1977 keep on file for seven (7) years
department of health shall maintain
compilations of the information submitted on the abortion reporting forms.
Except as provided in subsection (b) of this section, t
he compilations shall be available only to a local, state or national public health official or a physician upon his written request. The state health officer, in order to maintain and keep
such
the
compilations current, shall file with the reports any new or amended information.

The information submitted under W.S. 35

‑
107 and compiled under this section shall not be stored in any computer.

(b)

The department of health shall provide an annual report to the joint labor, health and social services interim committee
that shall include copies of abortion reports, with any identifying information redacted, and a statistical trend analysis of
the number of abortions performed in this state during the preceding calendar year.

This act is effect
ive July 1, 2009
