Short title.

This art
icle shall be known and may be cited as the
"
Wyoming Healthy Food Initiative Act
.
"

Definitions
.

(a)

As used in this article:

(i)

"Council" means the
Wyoming
business council;

(ii)

"Initiative" means the
Wyoming
healthy
foo
d initiative program;

(iii)

"
State institution" means those institutions established by W.S. 25

(a)

The
Wyoming

ealthy
F
ood
I
nitiative
A
ct
is created
to ensure that every
Wyoming
school lunch program and
state

institutional food service program shall be supplied, to the extent possible, by food grown, processed and prepared in
Wyoming
.
The initiative shall link Wyoming schools and
state
institutions with Wyoming farms and ranches to provide the
Wyoming
schools and
state
institutions with fresh and minimally processed farm and ranch commodities for inclusion in meals and snacks to help children and adults develop healthy eating habits and to improve direct access to markets for Wyoming farmers and ranchers.
The
purpose of the
initiative
i
s
to
emphasize and encourage:

(i)

Food that is additive
free,
minimally processed
and not genetically modified
;

(ii)

Hormone and antibiotic free meat
and dairy products
from healthy animals;

(i
i
i)

Fresh local produce and fruits
in season and additive free frozen products all year
;

(i
v
)

Pesticide and herbicide free grains and cereals;

(
v)

Pasture based dairy and eggs.

(b)

Where essential ingredients cannot be supplied by
Wyoming
based agricultural operations, the imported food shall adhere to the principles of the initiative
,
as closely as possible.

(c)

A
ll food supplied to the Wyoming school lunch program
s
and the
state
institutional food service program
s
shall be grown, processed and prepared under all applicable rules and regulation
s
to ensure safe and healthy food.

(d)

Wyoming
school districts
and state institutions
shall encourage the implementation of the initiative to emphasize the purchase of locally and regionally produced foods in order to improve child
and adult
nutrition and strengthen local and regional farm and ranch economies.

(e)

Additional benefits of the initiative may include activities that provide students with hands on learning opportunities, including
integrating nutrition and agriculture education into
Wyoming
school
and state institution
curricula, animal husbandry and cooking demonstrations, school gardening and composting programs and farm and ranch visits.

(a)

There is created an executive task force on the
Wyoming

ealthy

ood
i
nitiative
.

(b)

The task force shall be comprised of:

(i)

The agribusiness director of the council, who shall be the chairman of the task force;

(ii)

A representative of the department of education, appointed by the superintendent of public schools;

(

ii)

The director of the
Wyoming
department of agriculture, or his representative;

(iv)

The
director of the department of corrections, or his representative;

(v)

The director of the department of health, or his representative;

(vi)

The director of the department of family services, or his representative;

(v

)

A representative of the ranching industry, appointed by the
Wyoming
stock growers association;

(vi
ii
)

A representative of the ranching industry, appointed by the
Wyoming
wool growers association;

(

)

A representative of the farming industry, appointed by the
Wyoming

farm bureau federation
;

A representative of the farming industry, appointed by the

ountain farmers union;

A representative of the organic farming industry, appointed by the
council;

A representative of the agricultural marketing industry, appointed by
the
council;

A representative of the
agricultural
processing industry, appointed by the council;

(c)

The task force shall
convene no later than May 1, 2009 and thereafter shall meet at the call of the chairman. A majority of the members shall constitute a quorum. The task force shall
:

(i)

Determine the necessary technical and logistical infrast
ru
c
t

r
e necessary to link the agric
ultural farmers and ranchers with
the
Wyoming

school and
state
institutional consumers;

(ii)

Conduct a comprehensive review and evaluation of

the
food production, marketing, processing, storage, distribution and preparation system
s in
Wyoming
schools and
state
institutions
;

(iii)

Conduct a comprehensive review and evaluation of the kitchens, equipment and personnel at
Wyoming
schools and
state
institutions to determine the capability of processing, preparing and storing fresh, nutritious food from raw or frozen agricultural products;

(iv)

Conduct an analysis of all data, existing or gathered, of an implementation of a procurement portal, and any pilot project, to determine funding needs of
Wyoming
schools and
state
institutions
;

(v)

Conduct any other review and evaluation as the task force deems necessary
.

(
d
)

The
council
may contract with a consultant to assist in the facilitation of the task force duties and may consult with any other state, local or federal agencies, public or private stakeholders as the task force deems appropriate.

(
e
)

Staff support for the task force shall be provided by the council and by any state agency upon request.
Members of the task force who are government employees or public officials
shall not receive a salary but
shall be considered on official business of their agency when performing duties as members of the task force
and shall receive reimbursement for necessary travel and per diem expenses in the manner and amount provide by their agency
. Other
task force
members shall receive per diem
and travel expenses
in the amount
provided in W.S. 28

when
traveling to and from
task force
meetings and shall only receive salary in the same amount as legislators for actual task force meeting days
.

(
f
)

No later than October 1, 2009, the task force shall submit a
n initial
report
and no later than October 1, 2010 a final report,
to the joint agriculture, state and public lands and water resources, the joint education
, the joint judiciary
and the joint
labor, health and social services interim committees. The reports shall detail the task force's findings, recommend any marketing and education programs necessary to facilitate the Wyoming healthy food initiative program and recommend to any of the interim committees any statutory changes that may be required to implement the task force's
initial and
final recommendations.

(g
)

In addit
ion to the
appropriation
s
contained in section 2 of this act, the council may utilize existing resources and apply for any federal or private grants that may be available to augment funding for the task force study and report required under this act.

(h)

The task force shall terminate on December 31, 2010.

Section 2.

There is appropriated
six
ty
-
six thousand dollars ($66
,000.00)

from the
general
fund

to the
Wy
oming
business council to fund the expenses of the task force.

Th

appropriation

shall be for the period beginning with the effective date of this act and ending
December 31
, 2010.

Notwithstanding
any other provision of law, th
i
s appropriation shall not be transferred or expended for any other purpose and any unexpended, unobligated funds remaining from this appropriation shall
not
revert as provided by law on
June 30, 2010
, but will revert on December 31, 2010
.

business council's
2011-2012 standard biennial budget request.

This act is effective
immediately upon co

pletion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constit
