WORKING DRAFT 2009 STATE OF WYOMING 09LSO-0559 HOUSE BILL NO. HB0206 Care of animals after domestic violence . Sponsored by: Representative(s) Carson , Byrd, Connolly, Craft, Meyer and Throne A BILL for AN ACT relating to domestic animals; providing for the handling of domestic animals in the event of domestic violence; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section 1. W.S. 35 ‑ 21 ‑ 105(a) by creating a new paragraph (viii) and 35 ‑ 21 ‑ 107(b) by creating new paragraph (vi) are amended to read: 35 ‑ 21 ‑ 105. Order of protection; contents; remedies; order not to affect title to property; conditions . (a) Upon finding that an act of domestic abuse has occurred, the court shall enter an order of protection ordering the respondent household member to refrain from abusing the petitioner or any other household member. The order shall specifically describe the behavior that the court has ordered the respondent to do or refrain from doing. As a part of any order of protection, the court may: (viii) Direct the care, custody and control of any animal owned or kept by either party or a minor child residing in the household. 35 ‑ 21 ‑ 107. Emergency assistance by law enforcement officers; limited liability . (b) A local law enforcement officer responding to the request for assistance may take whatever steps are reasonably necessary to protect the victim from further domestic abuse, including: (vi) Providing or arranging temporary care, custody and control of any animal owned or kept by either party or a minor child residing in the household. Section 2. Th is act is effective July 1, 2009 . (END) 1 HB0206
