AN ACT relating to conservation districts; authorizing districts to
exercise their authority to coordinate
with federal agencies
and counties
to participate in rangeland monitoring and development of grazing operating plans;
authorizing rulemaking;
providing an appropriation; and providing for an effective date.

Be It Enacted by the Legislature of the State of
Wyoming
:

Section 1.

amended to read:

State board of agriculture; duties generally.

(a)

The commission shall:

(vii)

Authorize
, in consultation with counties,
and fund, to the extent funding is available, conservation districts to carry out duties authorized by W.S. 11

122(b)(xxviii). When
more than one

district
whose
boundaries
include
land

within
the jurisdiction of
a Wyoming
bureau of land management
field office request such authorization, the commission may designat
e a lead district
to carry out such duties in cooperation with all other affected districts
and counties
.

Powers and duties of districts and supervisors thereof generally
; rules and regulations
.

(b)

A conservation district organized under this act and the supervisors thereof, in addition to other powers granted by this act, may:

(xxviii)

Exercise the district's cooperating agency authority as granted by federal law in coordination
with one

or more
Wyoming
bureau of land management
field offices
and national forest service
offices

to:

(A)

Conduct rangeland monitoring on
lands within bureau of land management grazing allotments and national forest grazing allotments
.
Monitoring s
hall be
conducted
in
cooperation with
grazing permit holders
and
lessees and
federal agency
personnel;

(B)

Participate in the development of livestock grazing operating plans, permit renewals and transfers and resource plans to assure that such plans and permits are based upon and supported by credible monitoring data;

(C)

Procure
office space for
range professionals employed by or con
tracted for by the district
in the
most appropriate
bureau of land management
field office or national forest
service
office
.

(d)

The commission may adopt rules and regulations to implement the provisions of subsection (b) of this section.

from the general fund to the department of agriculture. This appropriation shall be for the period beginning with the effective date of this act and ending Ju

This appropriation shall only be expended for
the purposes of this act

Notwithstanding any other provision of law, this appropriation shall not be transferred or expended for any other purpose and any unexpended, unobligated funds remaining from this appropriation shall revert as provided by law on
July 1, 2010.

be included in the
department of agriculture

2011-2012 standard biennial budget request.

This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution.
