A BILL

for

AN ACT relating to
public education; initiating a program providing incentives for enhanced student achievement piloted in selected school districts; delegating responsibilities to the state superintendent; establishing a planning group to assist with program design; imposing reporting requirements; providing an appropriation;
and providing for an effective date.

Be It Enacted by the Legislature of the State of
Wyoming
:

Section 1.

(a)

T
he enhanced teacher performance program is established to provide incentives to teachers for improv
ing
student performance
by augmenting

compensation available to a district through
resources within the education resource block grant model
.

The program shall consist of demonstration grants
to be
available to selected school districts

for piloting teacher compensation program
s

in school year 2010
‑
2011
within
at least
one (1) of
the district's
schools whereby additional
teacher
compensation is based upon gains in student achievement
.

The state
superintendent

of public instruction
shall
,
through the department of education,

commence designing the
enhanced performance program
and shall by
November 1, 2009, report program recommendations to the joint education interim committee in accordance with this section.
In undertaking this effort, the state superintendent may contract
for
consulting expertise in ensuring
development and use of
valid and reliable
student achievement and performance evaluation measures required under this section and in
evaluating
recommendations of and assisting the planning group assembled under subsection (b) of this section.

(b)

To assist with
the selection of
participating school districts
and
program
design
, the state superintendent shall appoint a planning group comprised of
school district
teachers
and
administrators, members of the state board of education and parents
of children attending public schools
.
The state superintendent shall appoint planning group members by
May 1, 2009, to enable
selection of
five (5) school districts for program participation, with at least one (1) participating school within each
of the five (5)
district
s
, by August 1, 2009. In selecting participating school districts, the planning group shall use findings developed under the allocation and use study conduc
t
ed pursuant to 2008 Wyoming session laws, chapter 95, section 801, pertaining to the identification of successful schools based upon employed educational strategies.
Following
selection, the state superintendent shall
collaborate with the selected districts and the planning group to commence designing the following program components:

(i)

A growth model system of assessments and evaluation tools to measure student performance and achievement gains, with the goal to attach teacher performance to student achievement gains as opposed to absolute student achievement;

(ii)

A rigorous professional development and instructional facilitator program building upon successful strategies utilized by cost of education consultants in developing the education resource block grant model;

(iii)

Data capability supporting assessment tools necessary to measure student achievement gains
, sorting accurate and meaningful student achievement data by teacher and school
;

(iv)

Alignment of state educational standards, successful instructional strategies and student assessment systems.

(c)

Based upon collaborative efforts under subsection (b) of this section, the state superintendent shall
not later than
November 1, 2009, report
to the joint education interim committee on
program design recommendations together with necessary
funding
to
support

program implementation in selected districts for implementation in school
year
2010
‑
2011. Recommendations shall be aligned with the allocation and use study referenced under subsection (b) of this section and shall be in conjunction with 2010 model recalibration efforts undertaken by the legislature pursuant to W.S. 21
‑
13
‑
309(t) for consideration in the 2011 general session.

(d
)

For the period commencing with the effective date of this section and ending June 30, 2010, two hundred fifty thousand dollars ($250,000.00) is appropriated from the public school foundation program account to the department of education to fund costs for creating and convening the planning group established and required under subsection (b) of this section and for contractual services for obtaining required analytical and consulting expertise in carrying out duties imposed by this section.
