Be It Enacted by the Legislature of the State of

:

Section 1.

Violation of provisions to constitute misdemeanor; penalties.

(h)

The driver of any vehicle involved in an accident resulting in
the death or
serious bodily injury, as defi
n
ed by
W.S.

233(h), of another person shall, if issued a citation for a moving violation
under
this act, be required to appear personally in court for the disposition of the citation. If
the driver is
convicted of the moving violation
, except a conviction under W.S. 31
‑
5
‑
233(h),
and
the death or
serious bodily injury was the direct result of the conduct constitut
ing
the moving violation, the driver shall be subject to the
following penalties in addition to any other penalties prescribed by law:

(i)

For a first conviction be punished by a fine of not more than
five
hundred dollars ($

00.00), by imprisonment for not more
than six

months, or both;

(ii)

For a second
or subsequent
conviction
resulting in serious bodily injury
within one (1) year thereafter, be punished by a fine of not more than
one thousand

Records to be kept by division; exceptions.

(a)

The division shall maintain a readily available file of and suitable indexes for:

(iv)

All accident reports and abstracts of court records of convictions received under the laws of this state with suitable notations for each licensee showing the convictions of the licensee and the traffic accidents in which he has been involved.

1201(h) shall be notated on the licensee's record
for a period of ten (10) years following the conviction
.

Section 2.

This act is effective July 1, 2009.
