A BILL

for

AN ACT relating to
public schools; imposing specified requirements upon school districts contingent upon performance indicators; prescribing duties upon the state superintendent and the state board of education;
requiring reporting linked to model recalibration;
and providing for an effective date.

Duties of the state superintendent.

(f)

In administering the education resource block grant model pursuant to subsection (e) of this section, the state superintendent shall require each school district
subject to this subsection
to report to the department
of education on

the district's
implementation of model components identified under "Attachment A" as defined under W.S. 21
‑
13
‑
101(a)(xvii), as amended, and shall attach district employed
educational
strategies to those strategies underlying model components as used by consultants developing cost

based
model
components and contained in the 2005 cost of education study.
District expenditures of foundation program amounts guaranteed pursuant to W.S. 21
‑
13
‑
309(p) shall be related to its implementation of model components and associated educational strategies, and shall be reported in
a
manner, subject to criteria, on a form and within a prescribed time schedule established by department rule and regulation.
Effective school year 2009-2010 and each school year thereafter, a
ny s
chool district
not meeting any one (1) of the following student performance indicators during any school year shall be
subject to this subsection
:

(i)

A combined district score of seventy percent (70%) proficiency or greater
at the third grade level
on the statewide assessment for reading
;

(ii)

A combined district score of seventy percent (70%) proficiency or greater
at the eighth grade level on
the statewide assessment for mathematics
;

(iii)

A high school graduation rate of eighty percent (80%) or greater.

Duties of the state board of education.

(b)

In addition to subsection (a) of this section and any other duties assigned to it by law, the state board shall:

(ii)

Enforce the uniform state educational program standards imposed by W.S. 21

101 and 21

102 and the uniform student content and performance standards established by rules and regulations adopted under subsection (a) of this section by taking appropriate administrative action with the state superintendent, including but not limited to the changing of accreditation status
.

and for purposes of
carrying out paragraph (a)(ii) of this section and ensuring provision of educational programs providing students with opportunities to acquire sufficient knowledge and skills for entry into post secondary options and society in general,
the board
may

based upon reports from the

lower the accreditation status of any district subject to W.S. 21
‑

‑
202(f) until such time as the district is no longer subject to W.S. 21
‑

‑
202(f). The board
may
continue to lower the accreditation status of the district for each subsequent year the district remains subject to W.S. 21

Section 2.

In sufficient time to guide recalibration of the education resource block grant model required under W.S. 21
‑
13
‑
309(t)
for consideration by the 2011 legislature
, the department of education shall compile information reported under W.S. 21
‑
2
‑
202(f), as amended by section 1 of this act,
and report the compiled information to the joint education interim committee, together with an analysis of the compiled information targeting and identifying expenditures, practices and strategies associated with poor student achievement requiring further review, and incorporate recommendations for remedial action addressing identified problem areas.
