A BILL for AN ACT relating to public health; creating the cardiovascular education and outreach initiative program ; providing for a comprehensive diabetes and diabetes related cardiovascular disease education and control program; providing for screening and preventive treatment for diabetes and diabetes related cardiovascular disease as necessary support of the poor; authorizing positions; providing for the repeal of the program; requiring reports; providing an appropriation; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section 1. W.S. 35 ‑ 25 ‑ 301 through 35 ‑ 25 ‑ 304 are created to read: ARTICLE 3 CARDIOVASCULAR DISEASE EDUCATION AND OUTREACH INITIATIVE 35 ‑ 25 ‑ 301. Short title. This article shall be known and may be cited as the " Cardiovascular Disease Education and Outreach Initiative Act " . 35 ‑ 25 ‑ 302. Cardiovascular d isease education and outreach program . (a) The department of health shall develop a comprehensive cardiovascular education and outreach program . The goal of the program shall be to reduce , through education, prevention and behavior change, the number of people with diabetes who are at risk for developing cardiovascular disease. F or those individuals who are diagnosed with diabetes , the goal shall be to provide diagnostic, therapeutic and behavioral interventions that are evidence based and scientifically proven. The comprehensive cardiovascular disease education and outreach program shall include the following features : (i) An education and outreach component to demonstrate the interaction of heart disease and diabetes and steps a person can take to prevent both conditions; (ii) Evidence based early detection, screening, diagnosis and treatment of diabetes related cardiovascular disease ; ( iii) Research and data collection , including the development and use of a computer software based quality care monitoring system that is made available to health care providers, diabetes educators and cardiac rehabilitation facilities for the monitoring of diabetes patient care and collection of data related to blood pressure, blood lipids and glucosylated hemoglobin levels ; (iv) Intervention using a team approach with a team comprised of a registered nurse, registered dietician and a specialist in data collection and analysis ; (v) Use of Internet based or closed circuit video systems to disseminate informa tion regarding new, scientifically based methods of diabetes management and cardiovascular disease prevention ; (vi) To the extent appropriate, coordinat ion with and use of any educational or other supportive programs of nationally recognized heart and diabetes associations . (b) In financing and implementing the program established pursuant to subsection (a) of this section the department shall coordinate with and consider the use of the Medicaid program , the child health insurance program and any other state funded program providing health care or health education . This section does not constitute authorization to expand the services and eligibilities of the Medicaid program which requires specific legislative authorization. The department may recommend such authorization where appropriate. (c) The department may contract with one (1) or more third parties to develop and implement the program authorized by this section. Any contract awarded under this section shall be awarded on the basis of competitive bids and shall include specific requirements relating to outcome based evaluation. (d) Subject to the restriction of subsection (b) of this section, the department may accept state, federal, local and nongovernmental funds for developing and implementing the program established pursuant to this section. 35 ‑ 25 ‑ 303. Rulemaking authority ; legislative report. (a) The department shall, in accordance with the Wyoming Administrative Procedure Act, promulgate rules and regulations as appropriate to implement this article . ( b ) The department shall annually report on its activities, program outcomes, conclusions and goals under this article to the joint labor, health and social services interim committee and the joint appropriations interim committee. The report shall be due by October 1 of each year. 35 ‑ 25 ‑ 304. Repeal. This article is repealed effective July 1, 201 2 . Section 2 . (a) There is appropriated two hundred seventy - five thousand dollars ($275,000.00) from the tobacco settlement income account to the department of health . This appropriation shall be for the period beginning with the effective date of this act and ending June 30, 2010. This appropriation shall only be expended for the purpose of the cardiovascular education and outreach initiative created by this act . Notwithstanding any other provision of law, this appropriation shall not be transferred or expended for any other purpose and any unexpended, unobligated funds remaining from this appropriation shall revert as provided by law on June 30, 2010. An amount equal to two (2) times t his appropriation shall be included in the department's 2011-2012 standard biennial budget request. (b) The department of health is authorized three (3) at-will contract positions for the purposes of this act. Section 3 . This act is effective July 1, 2009. (END) 1 HB0266
