authorizing expenditures;
and providing for an effective date.

Section 1.

Material cost increase contingency account.

(a)

There is created the department of transportation material cost increase contingency account.
The
account
shall consist of monies appropriated or designated to the
account
by law
.

(b)

The department may request authorization from the governor to expend monies in the account to offset the increase in the fuel costs or costs of raw materials for any
department
project contract i
f the fuel costs or costs of raw materials for
the contract
have increased by more than twenty percent (20%) since the contract was executed.
On a quarterly basis, the department shall
review its
fuel costs and
the costs of raw materials used
directly by the d
epartment
for projects and compare those costs with the cost f
or the same amount of
fuel
and the co
st f
or
the same raw materials
a
t
the commencement of the preceding biennial state fiscal period
.
If the department documents that either of those costs have increased by more than twenty percent (20%) since th
at time it may request authorization from the governor to expend monies in an amount equal to the increased cost
s
.

(c)

If the governor
finds the
increase
s specified in subsection (b) of this section have been documented and the increases have not been reimbursed
previously
under this section he may
authorize the department to expend monies in the account
in amount
s

not to exceed the documented increases
.

There is appropriated

legislative stabilization reserve account
to the department of transportation material cost incre

se contingency account. This appropriation shall be for the period beginning with the effective date of this act and ending June 30, 2010. This appropriation shall only be expended as provided in W.S. 24

116. Notwithstanding any other provision of law, this appropriation shall not be transferred or expended for any other purpose and any unexpended, unobligated funds remaining from this appropriation shall revert as provided by law on June 30, 2010. This appropriation shall be included in the department of transportation's 2011-2012 standard biennial budget request.
