WORKING DRAFT 2009 STATE OF WYOMING 09LSO-0657 HOUSE BILL NO. HB0313 Licensing of employer day care facilities. Sponsored by: Representative(s) Quarberg A BILL for AN ACT relating to child care facility certification ; provi ding an exemption from certification for employer based child care facilities as specified; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section 1. W.S. 14 ‑ 4 ‑ 101 (a) by creating a new paragraph (viii) and 14 ‑ 4 ‑ 102 (b) by creating a new paragraph (x) are amended to read: 14 ‑ 4 ‑ 101. Definitions. (a) As used in W.S. 14 ‑ 4 ‑ 101 through 14 ‑ 4 ‑ 115: (viii) "Employer based child care facility" means a child caring facility operated by a n employer who is not in the business of keeping or caring for minor children and which is operated to provide care for the minor children of the employer's employees and: (A) Does not charge any fee for its services; (B) Is located on the premises of the employer's business; (C) Keeps and cares only for minor children of the employer's employees, or children for whom the employee is a legal guardian, and only during those times when the employee is working; and (D) Encourages and allows employees to participate in the care of their child during work hours or during work breaks. 14 ‑ 4 ‑ 102. Certification required; exceptions. (b) W.S. 14 ‑ 4 ‑ 101 through 14 ‑ 4 ‑ 111 do not apply to: (x) Employer based child care facilities. All employer based child care facilities who do not comply with W.S. 14 ‑ 4 ‑ 101 through 14 ‑ 4 ‑ 111 shall provide notice to their employees that their child care facility is not certified. The certifying authority , as defined by W.S. 14 ‑ 4 ‑ 101(a)(v), may inspect an employer based child care facility if it receives notice, or has reason to believe, that the facility is being operated so as to place the life, health or safety of a minor child in imminent danger. Section 2. This act is effective July 1, 2009. (END) 1 HB0313
