agriculture and animals; modifying the brucellosis
management
program; providing for spaying
of
heifers and other management practices; authorizing rulemaking;
and providing for an effective date.

Brucellosis
management
program.

(a)

The livestock board shall develop a brucellosis
testing

management
program which may be conducted with the help of veterinary practitioners and livestock auction markets. This program shall provide for the testing
, spaying
of
heifers and other management
of livestock
for brucellosis

pursuant to risk assessments and herd plans within the designated surveillance area
only to the extent that may be reasonably necessary to maintain
or to regain

the brucellosis-free status of the state of Wyoming.

(b)

The compensation for brucellosis surveillance testing
or spaying

shall be paid at not less than three dollars and fifty cents ($3.50) per head and not more than eight dollars ($8.00) per head of cattle actually tested

or spayed
. Compensation for brucellosis testing
or spaying

may include the purchase of brucellosis testing equipment, supplies and postage.

(c)

Payments under subsection (b) of this section shall be made monthly directly to accredited veterinarians who perform brucellosis testing
, spaying
and surveillance planning or to livestock auction markets that use their facilities and veterinarians to conduct brucellosis testing
as mandated by rule

or spaying to comply with brucellosis rules
of the Wyoming livestock board or the United States department of agriculture animal plant and health inspection service. The payment shall be made upon submission to the
Wyoming
livestock board of a notarized invoice indicating the number of head tested

or spayed
, the ownership of the animals tested

or spayed
and the
testing
location

of the testing or spaying
.

(d)

In addition to payments under subsection (b) of this section, payments may be made for fencing, feed and other preventive activities undertaken for the purpose of keeping cattle separated from elk in areas of high brucellosis prevalence in elk, provided that such payments shall be made only when
:

(i)

T
he activity is undertaken to comply with a quarantine order of the
Wyoming
state veterinarian
;
or

(ii)

The activity is

pursuant to
the terms of a livestock herd plan that has been entered into with the
Wyoming
state veterinarian.

(e)

The payment
under subsection (d) of this section
shall be made upon
completion of the fence, purchase of the feed or upon completion of other preventive activity and upon
submission to the Wyoming livestock board of a notarized invoice for materials or labor
, including the location and length of the fence, the amount of feed and a description of the preventative activity
.

(
f
)

The
Wyoming
livestock board may promulgate rules it deems necessary for the implementation of this section.
