Sponsored by: Senator(s) Jennings A BILL for AN ACT relating to civil procedure; specifying a condition that affect s the statute of limitations for collection of debt; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section 1. W.S. 1 ‑ 3 ‑ 119 is amended to read: 1 ‑ 3 ‑ 119. Effect of partial payment or new promise in writing. When payment has been made upon any demand founded on contract or a written acknowledgment thereof, or promise to pay the same has been made and signed by the party to be charged, the time for commencing an action runs from the date of such payment, acknowledgment or promise. A communication between the creditor and the debtor shall not toll the running of the statute of limitations under W.S. 1 ‑ 3 ‑ 105 if in the communication the debtor disputes or does not acknowledge the continuing existence of a debt . Section 2. This act is effective July 1, 2009. (END) 1 SF0041
