A BILL

for

AN ACT relating to
health care and the administration of government; providing for a health

care access demonstration project as specified; providing for a request for
information
; providing for a contingent joint legislative and executive oversight committee to succeed the health

care commission in overseeing the project; providing for a report; providing appropriations;
and providing for an effective date.

Be It Enacted by the Legislature of the State of
Wyoming
:

Section 1.

(a)

The
Wyoming
health

care commission shall issue a request for
information
from interested consulting firms, organization
s
or individuals to
be used in the
design
of
a detailed health

care access project to improve
access to
health

care and
the quality of
care
delivered in a rural environment while lowering health care costs
.

(b)

Information
in response to the request authorized by subsection (a) of this section shall include the following minimum requirements:

(i)

Selection of a project target population taking into consideration the ability to transfer the project design to another, possibly larger, population at a future date;

(ii)

Utilization of the medical home model in the delivery of health

care services;

(iii)

Improved reimbursement rates for participating providers
to cover the costs associated with services required in a medical home model. Participating providers shall
include
primary care
physicians, advanced
practice registered nurses and physician assistants;

(iv)

Demonstrated methods of improved access to health care;

(v)

Emphasis on improved quality of care and on preventive services;

(vi)

Cost containment strategies;

(vii)

Utilization of incentives and promotion of personal responsibility for improving health outcomes;

(viii)

Mechanisms to strengthen delivery of primary care;

(ix)

Strategies for providing
a continuum of care
for seriously ill patients identified in the target population;

(x)

Projected project costs
,
savings
and expected outcomes for the requirements identified in paragraphs (i) through (ix) of this subsection, including anticipated return for each dollar invested
;

(xi)

Objective data collection and evaluation methods specific to paragraphs (i) through (x) of this subsection
.

(c)

The request for
information
shall be prepared by the
Wyoming
health

care commission and issued by the
department of administration and information, genera
l services division
.
The commission shall review all
responses
and select
one (1) or more of the
responses
for detailed technical analysis, to include
fiscal
analysis. Upon completion of the detailed technical analysis, the commission shall recommend
one
(1)

or more
project designs for improved health care access
to the
governor and the
joint labor
,
health and social services interim committee. The recommendation shall include a description of project design criteria
and
an itemization of all project costs to be included in any legislative appropriation for the project.
The recommendation may include technical analysis of any already implemented access project.
The commission's
design
recommendation and report shall be made no later than November 1, 2009.

Section 2.

(a)

If the
Wyoming
health

care commission sunsets as currently scheduled on June 30, 2009, responsibilities assigned to the commission under this act shall be performed by an oversight committee
, subject to the following:

(i)

The oversight committee shall consist of
:

(A)

One (1)
representative of the governor's office appointed by the governor;

(
B
)

One (1)
representative of the department of health appointed by the director;

(
C
)

One (1)
representative of the
insurance department appointed by the commissioner;

(
D
)

One (1) senator appointed by the president of the senate and one (1) representative appointed by the speaker of the house;

(
E
)

One (1) person appointed before June 30, 2009 by the health

care commission and who
was
a member of the health

care commission;

(
F
)

One (1) member of the joint labor, health and social services interim committee appointed by the chairmen of the committee.

(ii)

Members of the committee shall select a chairman and a vice chairman;

(iii)

The committee shall meet at the call of the chairman and shall convene its first meeting no later than July 30, 2009. The committee shall review, evaluate the status of the health

care commission's work on the project and shall complete the tasks provided in
section 1
of this
act
;

(iv)

The committee shall issue a final report to the governor and the joint labor, health and social services interim committee no later than November 1, 2009,
as provided in
sub
section (c)
of section 1
of this act;

(
v
)

The
committee
shall be staffed by the governor's office. The
committee
may contract for administrative and research services to aid in preparation of the
committee
report
;

(
vi
)

The
committee
shall exist until March 15, 20
10;

(
vii
)

Members of the
committee
shall be paid as follows:

(
A
)

Legislative members of the committee shall be paid salary, per diem and travel expenses as provided in W.S. 28
‑
5
‑
101 for their official duties as members of the committee;

(
B
)

State employees serving on the
committee
shall receive no additional compensation for serving on the
committee
, but shall be paid as provided in W.S. 9
‑
3
‑
102 and 9
‑
3
‑
103 for travel and per diem expenses incurred for their official duties as members of the
committee
;

(
C
)

All other members of the
committee
shall not receive a salary but shall be paid as provided in W.S. 9
‑
3
‑
102 and 9
‑
3
‑
103 for travel and per diem expenses incurred for their official duties as members of the
committee
.

Section 3.

(a)

There is appropriated two hundred forty thousand dollars ($240,000.00) from the general fund to the governor's office. This appropriation shall be for the period beginning with the effective date of this act and ending June 30, 2010. This appropriation shall only be expended for the purpose of staffing and funding meetings of the
oversight committee

created by this act
and to contract with appropriate professionals as necessary to complete the
committee
study. Notwithstanding any other provision of law, this appropriation shall not be transferred or expended for any other purpose. Funds appropriated under this subsection shall not revert until June 30, 201

.

(b)

There is appropriated
ten
thousand dollars ($
1
0,000.00) from the general fund to the legislative service office. This appropriation shall be for the period beginning with the effective date of this act and ending June 30, 201

. This appropriation shall only be expended for the purpose of paying salary, per diem and mileage for legislative members of the
oversight committee

created by this act
and per diem and mileage for legislative appointees. Notwithstanding any other provision of law, this appropriation shall not be transferred or expended for any other purpose. Funds appropriated under this subsection shall not revert until June 30, 201

Section
4
.

This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution.
