Applicability and scope.

(a)

This act shall apply to any health benefit plan which provides coverage to two (2) or more employees of a small employer in this state if:

(i)

Any portion of the premium or benefits is paid by a small employer or if an eligible employee or dependent is reimbursed, whether through wage adjustments or otherwise, by a small employer for any portion of the premium
unless the small employer has not offered any health benefit plan to its employees in the immediately
preceding
eighteen (18) months
; or

Section 2.
This act is effective July 1, 2009.
