AN ACT relating to the Medical Practice Act; providing an exemption from the Medical Practice Act for the practice of midwifery; and providing for an effective date.

103(a) by creating a new paragraph (xi) and by creating a new subsection (b) is amended to read:

Applicability of chapter.

(a)

This chapter does not apply to:

(xi)

Any person who practices direct entry midwifery if that person:

(A)

Does not in any manner advertise, hold himself out or otherwise represent that he is authorized to practice medicine;

(B)

Does not in any manner otherwise perform any of the other acts specified in W.S. 33

102(a)(xi), except delivering or assisting in the delivery of infants and the management of pregnancy and parturition; and

(C)

Is registered with the board, verifying that he has successfully completed requirements established by the North American registry of midwives for certified professional midwives.

(b)

For purposes of this section, "direct entry midwife" means an independent practitioner educated in the discipline of midwifery through self-study, apprenticeship, a midwifery school or a college or university-based program distinct from the discipline of nursing. A direct entry midwife is trained to provide the midwifes' model of care to healthy women and newborn infants throughout the child bearing cycle primarily in out-of-hospital settings.

Section 2.

This act is effective July 1, 2009.
