Subject: Adding "attempt" as an element of aggravated assault and battery. Summary/Major Elements: Under current law, a person is guilty of aggravated assault and battery if he causes serious bodily injury to another intentionally, knowingly or recklessly under circumstances manifesting extreme indifference to the value of human life. This bill adds "an attempt to cause" serious bodily injury under those same circumstances to the crime of aggravated assault and battery. Note: Final action on this bill was not taken at the time this summary was prepared. Should changes be made to the bill upon final passage, an updated summary will be transmitted to all legislators.
WORKING DRAFT ORIGINAL SENATE FILE NO. 0084 ENROLLED ACT NO. 87, SENATE SIXTIETH LEGISLATURE OF THE STATE OF WYOMING 2009 GENERAL SESSION AN ACT relating to crimes and offenses; adding attempt to cause serious bodily injury manifesting extreme indifference to the value of human life as a new means of committing aggravated assault; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section 1. W.S. 6 ‑ 2 ‑ 502(a)(i ) is amended to read: 6 ‑ 2 ‑ 502. Aggravated assault and battery; penalty. (a) A person is guilty of aggravated assault and battery if he: (i) Causes or attempts to cause serious bodily injury to another intentionally, knowingly or recklessly under circumstances manifesting extreme indifference to the value of human life; Section 2. This act is effective immediately upon co m pletion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constit u tion.
