Current law excludes from
eligibility under the Wyoming health insurance pool act persons who are
eligible for health insurance under an employer sponsored group health plan.

The act makes those persons
eligible if the cost to insure them under the employer sponsored group plan
exceeds the applicable pool rate by at least twelve and one-half percent.

The act limits that
eligibility to times when plan enrollment does not exceed ninety-five percent
of the plan's maximum enrollment capacity.
