AN ACT relating to
junk dealers; requiring records for certain transactions involving metal as specified; requiring certain purchases to be by check or other recordable means;
and providing for an effective date.

:

Section 1.

(a)

Every person, firm or corporation engaged in the junk business as defined in W.S. 33
‑
18
‑
101, shall keep a book, in which shall be written in ink, at the time of each and every sale, an accurate account and description, in the English language, of all junk metal or rubber goods purchased or sold, and the name and residence of the person selling or buying the same. No entry in such book shall be erased, mutilated or changed.

(b
)

In addition to the book required under subsection (a) of this section, each junk dealer shall
create and
keep
for not less than two (2) years
a written or electronic record for each purchase or trade of:

(i)

Copper, brass or bronze in any form;

(ii)

Aluminum wire, cable, pipe, bar, ingot, rod
fitting
or fastener; or

(iii)

Material containing copper or aluminum which is used for farming purposes.

(c
)

Each record
required under subsection (b) of this section shall include:

(i)

The name and address of the person delivering the metal property to the junk dealer including a copy
of a current, valid photo identification;

(ii)

The date of the transaction;

(iii)

The weight, quantity or volume of metal property involved in the transaction and a general description of the property;

(iv)

The amount paid for the property; and

(v)

The license plate number and description of the vehicle used to deliver the property.

(d)

No junk dealer shall pay more than two hundred fifty dollars ($250.00) in cash for any metal product as specified in subsection (b) of this section and purchases of those products for more than two hundred fifty dollars ($250.00) shall be made by check or other recordable means.

Section 2.

This act is effective July 1, 2009.
