Subject: Establishes a mandatory minimum sentence for first degree sexual abuse of a minor as specified. Summary/Major Elements: Under current law, a person convicted of first degree sexual abuse of a minor is subject to imprisonment for not more than 50 years, unless the person is subject to a sentence of life imprisonment without the possibility of parole as a result of a prior conviction for specified sexual offenses. This bill provides that an actor who is at least 21 years of age and is convicted of first degree sexual abuse of a minor under the age of 13, shall be subject to imprisonment for not less than 25 years, nor more than 50 years, unless the actor has a prior conviction for specified sexual offenses, in which case the actor may be subject to a sentence of life imprisonment without the possibility of parole.
WORKING DRAFT ORIGINAL HOUSE BILL NO. 0064 ENROLLED ACT NO. 47, HOUSE OF REPRESENTATIVES SIXTIETH LEGISLATURE OF THE STATE OF WYOMING 2010 BUDGET SESSION AN ACT relating to crimes and offenses; establishing a mandatory minimum sentence for first degree sexual abuse of a minor when the actor is at least twenty-one years of age and the victim is less than thirteen years of age; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section 1. W.S. 6 ‑ 2 ‑ 314(b) and by creating a new subsection (c) is amended to read: 6 ‑ 2 ‑ 314. Sexual abuse of a minor in the first degree; penalties. (b) Except as provided in subsection (c) of this section, a person convicted under subsection (a) of this section is subject to imprisonment for not more than fifty (50) years, unless the person convicted qualifies under W.S. 6 ‑ 2 ‑ 306(e) . (c) A person convicted under paragraph (a)(i) of this section, where the actor is at least twenty-one (21) years of age, is subject to imprisonment for not less tha n twenty-five (25) years nor more than fifty (50) years, unless the person convicted qualified under W.S. 6 ‑ 2 ‑ 306(e) . Section 2. This act is effective July 1, 20 10 .
