A BILL

AN ACT relating to
school finance; providing for advance payments to specified districts from the school foundation program

account;
and providing for an effective date.

Be It Enacted by the Legislature of the State of
Wyoming
:

Section 1.

by creating a new subsection (h)
is amended to read:

Distribution of funds from foundation account; property tax and cash reserve adjustment; regulations
; advance payments
.

(h)

In
lieu of entitlement payments under
subsections (b)
and
(c)

of this section,
the state superintendent shall, for any district receiving an entitlement amount as computed under W.S. 21
‑
13
‑
311(a) in the immediately preceding school year which was equal to or less than twenty percent (20%) of the guarantee amount computed for that district under W.S. 21
‑
13
‑
309(p) for that same school year, provide
payments to that district for the current school year equal to one-third (1/3) of the guarantee amount determined for that district under W.S. 21
‑
13
‑
309(p) fo
r
the current school year, reduced by an amount equal to one-third (1/3) of the entitlement amount computed for that district
under W.S. 21
‑
13
‑
311(a) for the current school year. The computed amount shall be paid to each eligible district
in two (2) separate payments
on August 15 and October 15 of each school year
. On or before December 15 of the current school year, the actual entitl
e
ment amount shall be computed for each
recipient district
in accordance with W.S. 21
‑
13
‑
311(a) and the recipient district shall repay the foundation program account any amount paid under this subsection which is in excess of the
computed
entitlement amount

for that district for
the current school year.

If the entitlement amount computed for any recipient district is greater than the amount of payments received by that district under this subsection for the current school year, any difference shall be paid to that district in the February 15 entitlement payment in accordance with subsection (c) of this section.

Section 2.

This act is effective July 1, 2010.
