Summary/Major Elements:

Currently, contracts for the
minor repair of automobile dents, dings, tire damage and other minor damage are
considered insurance contracts under the insurance code.

This act brings such
contracts into the definition of "service contracts" regulated
differently under the insurance code.

The act defines "service
contracts" to include contracts for one or more of the following:

The removal of dents, dings
or creases that can be repaired using paintless dent removal and without
replacing body panels, sanding, bonding or painting;

Repair or replacement of
tires or wheels damaged by ordinary road hazards unless the contract is with a
tire or wheel manufacturer;

Repair of small windshield
chips or cracks without replacement of the entire windshield; and

Repair of damage to interior
components caused by wear and tear without replacement of the interior
components.

Definitions.

(a)

As used in this article:

(ix)

"Service contract" means a contract or agreement for a separately stated consideration for a specific duration to perform the repair, replacement or maintenance of property or indemnification for repair, replacement or maintenance, for the operational or structural failure due to a defect in materials or workmanship or normal wear and tear, with or without additional provision for incidental payment or indemnity under limited circumstances, including, but not limited to, towing, rental and emergency road service. Service contracts may provide for the repair, replacement or maintenance of property for damage resulting from power surges and accidental damage from handling

"Service contract" also includes a contract or agreement for one (1) or more of the following:

(I)

The removal of dents, dings or creases that can be repaired using the process of paintless dent removal without affecting the existing paint finish and without replacing vehicle body panels or sanding, bonding or painting;

(II)

The repair or replacement of tires or wheels damage

as a result of coming into contact with ordinary road hazards including, but not limited to, potholes, curbs, rocks, wood debris, metal parts, glass, plastic or composite scraps. A cont

act or agreement meeting the definition set forth in this subparagraph in which the party obligated to perform is either a tire or wheel manufacturer or a motor vehicle manufacturer is exempt from the requirements of this chapter;

(III)

The repair of small windshield chips or cracks but which expressly excludes the replacement of the entire windshield;

(IV)

The repair of damage to the interior components of a motor vehicle caused by wear and tear but which expressly excludes the replacement of any part or component of a motor vehicle's interior.

Section 2.

This act is effective July 1, 2010.
