Sponsored by: Senator(s) Sessions A BILL for AN ACT relating to juvenile services; requiring payment of specified services for juveniles under the Juvenile Justice Act and the Children in Need of Supervision Act by boards of county commissioners when certain conditions are present; providing for release from the requirement when the specified conditions are no longer present; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section 1. W.S. 14 ‑ 6 ‑ 235 by creating new subsection s (e) and (f) and 14 ‑ 6 ‑ 435 by creating new subsection s (c) and (d) are amended to read: 14 ‑ 6 ‑ 235. Fees, costs and expenses. ( e ) Any costs for any services that would otherwise be paid by the state for juveniles under this act shall be paid by the board of county commissioners of the county where the proceedings under this act are held as follows : (i) In those counties where the number of juveniles removed from their homes and placed in the custody of the department under this act in the pre c eding twelve (12) month s is ten (10) or fewer, and at least t wo ( 2 ) of those juveniles returned home and subsequently were placed in the custody of the department within twelve (12) months after their initial release from the custody of the department , t he services that shall be paid by the board of county commissioners shall include a ll costs that would otherwise be paid by the state for each such juvenile who returned home and was subsequently placed in the custody of the department under this act within twelve (12) months after being released from the custody of the department . The costs the board of county commissioners shall be required to pay under this subsection shall not include any costs that the juvenile 's parents or any other person who may be legally obligated to support the juvenile would be required to pay ; (ii) In those counties where the number of juveniles removed from their homes and placed in the custody of the department under this act in the preceding twelve (12) months is more than ten (10), and the percentage of those juveniles who returned home and subsequently were placed in the custody of the department within twelve (12) months after their initial release from the custody of the department is equal to or exceeds twenty percent (20%) , the services that shall be paid by the board of county commissioners shall include all costs that would otherwise be paid by the state for each such juvenile who returned home and was subsequently placed in the custody of the department under this act within twelve (12) months after being released from the custody of the department . The costs the board of county commissioners shall be required to pay under this subsection shall not include any costs that the juvenile 's parents or any other person who may be legally obligated to support the juvenile would be required to pay. (f) Costs for services that are paid by the county under subsection (e) of this section shall cease when statistics compiled by the department show that the rate of juveniles within the county who returned home after being placed in the custody of the department under this act , and who were again placed in the custody of the department within twelve (12) months after their initial release from the custody of the department, does not meet the criteria specified in paragraph (e)(i) or (ii) of this section. 14 ‑ 6 ‑ 435. Ordering payment for support and treatment of child; how paid; enforcement. ( c ) Any costs for any services that would otherwise be paid by the state for children under this act shall be paid by the board of county commissioners of the county where the proceedings under this act are held as follows : (i) In those counties where the number of children removed from their homes and placed in the custody of the department under this act in the preceding twelve (12) months is ten (10) or fewer, and at least t wo ( 2 ) of those children returned home and subsequently were placed in the custody of the department within twelve (12) months after their initial release from the custody of the department , the services that shall be paid by the board of county commissioners shall include all costs that would otherwise be paid by the state for each such child who returned home and was subsequently placed in the custody of the department under this act within twelve (12) months after being released from the custody of the department .
