Right of eminent domain granted; ways of necessity for authorized businesses; purposes; extent
.

(d)

The right to exercise the power of eminent domain for electric power transmission and distribution
, as

granted by subsection (a) of this section,
shall be exercised only by those persons meeting the definition of a public
utility
as defined by W.S. 37

‑
101(a)(vi)(C)
and
by a
ny cooperative electrical generation and transmission association operating in interstate commerce whose rates are not regulated by the Wyoming public service commission.

Section 2.

This act is effective July 1, 2010.
