Summary/Major Elements:

This act makes illegal
stocking of fish a high misdemeanor.

The act permits a court to
revoke and suspend the privilege of purchasing any hunting, fishing or other
game & fish license of any person convicted of illegal stocking of fish.
The suspension can be up to a lifetime suspension.

The act allows the game and
fish commission to bring a case for civil penalties against a person convicted
of illegal stocking of fish. Civil penalties are limited to the costs incurred
by the commission in removing the illegally stocked fish.

The act specifies that the
escape of lawfully stocked fish or fish eggs does not constitute a violation.

Section 1.

Fish stocking in waters without consent prohibited; penalties.

(a)

No person shall plant or release any fish or fish eggs in any
public
waters of
Wyoming
without the consent and under the supervision of the department or its authorized personnel.

(b)

The escape of lawfully stocked fish or fish eggs does not constitute a violation of this section.

Violation of this section constitutes a
high
misdemeanor punishable as provided in W.S. 23

202(a)
(ii).

The court may, in its discretion, revoke any license issued under this act to any person convicted of a violation of this section, for the remainder of the year in which the conviction occurs, and may suspend the person's privilege to purchase or receive any other license under this act or to take any wildlife for
a period of time up to and including lifetime revocation
.

)

In addition to any other criminal penalty provided in this act, any person who violates this section may be assessed civil penalties in an amount not to exceed the costs incurred by the commission in removing the fish or fish eggs from the waters affected by the violation. The commission may bring a civil action in any court of competent jurisdiction for civil penalties or injunctive relief.

This act is effective July 1, 2010.
