Sponsored by: Representative(s) Petersen, Brechtel, Buchanan, Gay, Hunt, Kroeker, Lubnau, Quarberg and Teeters and Senator(s) Geis, Hicks and Nutting A BILL for AN ACT relating to marriage ; providing that marriage s other than of a male and a female person are void ; provi ding that marriage s between more than two parties are void; providing that marriages and domestic civil unions which would be void if contracted in Wyoming shall not be given effect in Wyoming; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section 1 . W. S. 20 ‑ 1 ‑ 111 and 20 ‑ 2 ‑ 101(a) by creat ing new paragraphs (iv) and (v) and by creating a new subsection (h) are amended to read: 20 ‑ 1 ‑ 111. Out of state marriages. (a) All marriage contracts which are valid by the laws of the country under the authority of the foreign nation in which contracted are valid in this state , provided that such marriage contracts are betw een a male and a female person . (b) All marriage contracts which are valid under the authority of a state, commonwealth, territory, district or possession of the United States are valid in this state provided that such marriage contracts are between a male and a female person. 20 ‑ 2 ‑ 101. Void and voidable marriages defined; annulments. (a) Marriages contracted in Wyoming are void without any decree of divorce: (iv) When the parties are not a male and a female person ; or (v) When there are more than two (2) parties to the contract. ( h) A party to a domestic civil union or marriage which would be void under subsection (a) of this section if contracted as a marriage in Wyoming, shall not be entitled to the legal obligations, responsibilities, protections or benefits afforded or recognized by the law of Wyoming to married persons and spouses, whether they derive from statute, administrative rule, policy, common law or any other source of civil or criminal law. Section 2. This act is effective immediately upon co m pletion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constit u tion. (END) 1 HB0074
