WORKING DRAFT 2011 STATE OF WYOMING 11LSO-0347.E1 HOUSE BILL NO. HB0085 Teacher suspensions. Sponsored by: Representative(s) McKim, Davison, Jaggi, McOmie and Teeters and Senator(s) Dockstader A BILL for AN ACT relating to teacher contracts; revising the process for suspension of teachers; requiring an investigation as specified; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section 1. W.S. 21 ‑ 7 ‑ 110(a) and (b) is amended to read: 21 ‑ 7 ‑ 110. Suspension or dismissal of teachers; notice; hearing; independent hearing officer; board review and decision; appeal. (a) The board may suspend or dismiss any teacher or terminate any continuing contract teacher for incompetency, neglect of duty, immorality, insubordination, unsatisfactory performance or any other good or just cause. If the board proposes to suspend or dismiss a teacher pursuant to this subsection, the teacher shall be notified of the proposed suspension or dismissal and shall be immediately suspended with pay, pending the outcome of an investigation by the superintendent or his designee into the alleged misconduct of the teacher. Following the investigation, the superintendent shall recommend reinstatement or initiate proceedings as provided in subsection (b) of this section. A teacher shall not be suspended without pay prior to the outcome of a hearing under subsection (c) of this section. (b) Suspension or dismissal Following an investigation under subsection (a) of this section, proceedings shall under subsection (c) of this section may be initiated by the superintendent or any member of the board designated by the superintendent or designated by the board pursuant to a majority vote of the board delivering to the teacher a written notice of suspension or dismissal, together with written reasons by delivering to the teacher a written notice of the findings and outcome of the investigation conducted by the superintendent or his designee and notice that proceedings under subsection (c) of this section have been initiated. During the pendency of the proceedings under subsection (c) of this section, the teacher shall remain on suspension with pay . Section 2. This act is effective July 1, 2011. (END) 1 HB0085
