Bill No.: <billno> Drafter: <drafterinit> Bill No.: HB0090 Drafter: MDO LSO No.: 11LSO-0428 Effective Date: 7/1/2011 Enrolled Act No.: HEA0080 Chapter No.: 172 Prime Sponsor: Representative Byrd Catch Title: Vehicle restoration. Subject: Obtaining title to a vehicle that is being restored for personal use when no certificate of title for the prior owner is available. Summary/Major Elements: ● Provides for issuance of title to a vehicle when no title is available, without posting a bond, if: o The applicant is restoring the vehicle for his own personal use; and o The applicant presents an affidavit of vehicle ownership, a notarized bill of sale, a certified written statement of the value of the vehicle and a VIN inspection, at the time of application. ● If the value of the vehicle cannot be determined from any prior registration or title, the applicant shall provide the county clerk the value of the vehicle from a national appraisal guide, or a certified written statement obtained from a licensed Wyoming vehicle dealer stating the appraised value of the vehicle. ● Any title issued under this act shall state on its face that it is nontransferable for one hundred eighty (180) days from the date title issued. ● A vehicle shall only be eligible to be titled under this subsection if, on the date the applicant purchased the vehicle it was not operational and could not have been rendered operational without substantial repairs to one (1) or more of the vehicle's mechanical systems. ● Provides rulemaking authority to WYDOT to define the term "substantial repairs".

WORKING DRAFT ORIGINAL HOUSE BILL NO. 0090 ENROLLED ACT NO. 80, HOUSE OF REPRESENTATIVES SIXTY-FIRST LEGISLATURE OF THE STATE OF WYOMING 2011 GENERAL SESSION AN ACT relating to motor vehicles; amending provisions for issua nce of a title to a vehicle which requires restoration as specified; providing rulemaking authority; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section 1. W.S. 31 ‑ 2 ‑ 105 by creating a new subsection (f) is amended to read : 31 ‑ 2 ‑ 105 . Duplicate titles; affidavit of vehicle ownership; bond for certificate of title. (f) If an applicant is applying for title to a vehicle which he will restore for his own personal use , title may be issued without a bond required by this section if the applicant presents an affidavit of vehicle ownership, a notarized bill of sale, a certified written statement of the value of the vehicle and a vehicle identifi cation number (VIN) inspection , at the time of application. If the value of the vehicle cannot be determined from any prior registration or title, the applicant shall provide the county clerk the value of the vehicle. The value of the vehicle shall be determined from any current national appraisal guide, or the applicant may elect to submit a certified written statement obtained from a properly licensed Wyoming vehicle dealer stating the appraised value of the vehicle. Any title issued under this subsection shall state on its face that it is nontransferable for one hundred eighty (180) days from the date title issu ed. Notwithstanding the other requirements of this subsection, a vehicle shall only be eligible to be titled u nder this subsection if , on the date the applicant purchase d the vehicle it was not operational and could not have been rendered operational without substantial repairs to one (1) or more of the vehicle's mechanical systems. The department shall define the term "substantial repairs" by rule and regulation. Section 2. This act is effective July 1, 2011.
