(a)

An owner of a dog that bites or otherwise attacks in a vicious manner a game and fish law enforcement officer, who is discharging his duties on public lands, is guilty of a misdemeanor punishable as provided in this section. It is an affirmative defense to prosecution under this section that the dog was attempting to protect livestock at the time of the attack.

A first violation of subsection (a) of this section constitutes a low misdemeanor as punishable as provided in W.S. 23

202(a)(v). A second or subsequent violation of subsection (a) of this section constitutes a high misdemeanor punishable as provided in W.S. 23

202(a)(ii).

Section 2.

This act is effective July 1, 2011.
