A BILL

for

AN ACT relating to
government reorganization;
providing for the merger of the programs and functions of the department of employment and the department of workforce services;
specifying that the remaining department shall be known as the department of workforce services;
requiring reports;

and providing for effective date

Section 1.

(h)

From and after July 1, 2011, the department of employment shall be merged with the department of workforce services created by W.S. 9

2601. The merged department shall be known as the department of workforce services
.

Any statute or legal or other document which refers to the department
of employment
means the department of
workforce services
which is the successor agency to
the department of
employment
.

From and after July 1, 2011, the department of workforce services shall be merged with the department of
employment
created by W.S. 9

. The merged department shall be known as the department of workforce services.

Section 2.

(a)

The governor shall appoint
one
(1)
person to serve as

joint
director of the department of employment and
director of the department of
workforce services
from the effective date of this act until July 1, 2011
.
Thereafter the governor shall appoint a director of the department of workforce services by temporary appointment as provided in W.S. 28

101(b).

(b)

The

director shall
plan for the
merge
r
and consolidat
ion of
the divisions, agencies, programs and functions
assigned to the department of employ
ment
pursuant to W.S. 9
‑
2
‑
2002 and to the department of workforce services pursuant to W.S. 9
‑
2
‑
2
018
, with the merger effective from and after July 1, 2011
.

(c)

The assignment of programs and function from the department of employment and from the department of workforce services to the department of workforce services shall be deemed a type 1 transfer as defined in W.S. 9
‑
2
‑
1707(b)(i).

)

The director
of the department of workforce services
shall
prepare a
status
report on the merger of the department of employment and the department of workforce services
.
The
report
shall be submitted to the
governor and the
joint labor, health and social services interim committee
of the legislature no later than October 15, 2011
and made available to the public.
The report shall include recommendations on the further consolidation of the department of employment and workforce services' programs and functions, including recommended additional legislation to effectuate the merger.
The joint labor, health and social services interim committee shall report to the legislature by December 1, 2011,
any
recommendations
resulting from the department's report
, including necessary legislation
to further implement
the
merger
.

(a)

Subsections 2(a) and 2(b) of t
his act
are
effective immediately upon co
m
pletion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constit
u
tion.

(b)

Except as provided in subsection (a) of this section, this act is effective July 1, 2011.
