A BILL

for

AN ACT relating to
federal education funds; requiring an investigation of state impact of nonacceptance of such funds; requiring a report;
and providing for an effective date.

Be It Enacted by the Legislature of the State of
Wyoming
:

Section 1.

(a)

The Wyoming attorney general
in cooperation with
the state superintendent of public instruction shall investigate the impact
and ramifications

to the state of Wyoming should it elect to not accept revenues made available to the state by the federal government for Wyoming public schools
serving students in kindergarten through grade twelve (12)
. The investigation shall
review and determine the effect of such action on
:

(i)

Re
quirements imposed by federal law and regulation on the state for execution and implementation of
k
indergarten through grade twelve (12) programs and services provided in Wyoming public schools;

(ii)

Delivery of public education programs and services to
k
indergarten through grade twelve (12) students as required by Wyoming Constitution and by state law;

(iii)

Receipt of federal education dollars
for educational programs and services offered prior to and
beyond
k
indergarten through grade twelve (12);

(iv)

Receipt of federal dollars to the state for noneducation purposes.

(b)

On or before November 1, 2011, the results of the investigation conducted under subsection (a) of this section shall be reported to members of the joint education interim committee and the joint appropriations interim committee. The report shall be made in sufficient time to guide development of any necessary legislative recommendations for consideration in the 2012 budget session.

Section 2.

effective immediately upon co

pletion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constit

tion.
