Be It Enacted by the Legislature of the State of
Wyoming

909(a) by creating a new paragraph (xi) is amended to read:

State engineer; powers generally.

(a)

In the administration and enforcement of this act and in the effectuation of the policy of the state to conserve its underground water resources, the state engineer is authorized and empowered on advice and consent of the board of control:

(xi)

To require any person producing water from
geologic sequestration of carbon dioxide in saline aquifers
to adequately demonstrate that the water produced
, unless reinjected below the surface or otherwise disposed of in accordance with W.S. 35

will be put to a beneficial use beyond the mere
production
, and to require that person to obtain

a permit under W.S. 41
