Cultural event permit; authorized; requirements; restrictions.

(a)

The appropriate licensing authority in a county, city or town may issue a cultural event permit to any responsible person or organization for sales of alcoholic liquors and malt beverages at public auditoriums, civic centers, theaters, arenas or event centers meeting the qualifications of subsection (b) of this section. The issuance of a permit under this section shall not be considered an alcoholic beverage permit issued on the basis of population as provided in W.S. 12

nor a special malt beverage permit as provided in W.S. 12—4-504
.

(b)

The holder of the cultural event permit shall own or hold a written lease for the premises for the period
for
which the permit is issued
. Except as provided in this subsection, a
cultural event permit shall not be sold, transferred or assigned by the holder
.

Any political subdivision issued a cultural event permit may contract for or otherwise subcontract the concessions operations of the food and beverage services associated with
the permit
to another individual or entity without
transferring the permit
.

(c)

The holder of a cultural event permit may dispense alcoholic liquors and malt beverages from any location within the boundaries of the owned or leased premises under the same fee. The premises shall be a single property within a contiguous boundary upon which the
building qualifying for the
cultural event permit is located and which shall be identified in the permit as approved by the local licensing authority. The licensing authority shall, as often as necessary, inspect the permitted rooms or locations where alcoholic liquors and malt beverages are served t
o e
nsure that the permittee is in compliance with sanitation and fire hazard requirements and other applicable laws. W.S. 12-5-201 shall not apply
to a holder of a cultural event
permit.

(d)

The issuing body shall provide rules and regulations for the following:

(i)

The location of the dispensing rooms or locations where alcoholic liquors and malt beverages may be sold;

(ii)

The location of areas where alcoholic liquors and malt beverages may be consumed;

(iii)

The hours and days of the operation of the dispensing rooms and locations where alcoholic liquors and malt beverages are being sold and consumed.

(e)

No person or organization holding the cultural event permit shall sell any alcoholic liquor
or
malt beverages for consumption off the premises authorized by the permit. It shall be the duty and obligation of the issuing body and the holder of the permit to see that no sales are made to any person under the age of twenty-one (21) years.

(f)

All sales of alcoholic liquors and malt beverages authorized by a cultural event permit shall cease at the conclusion of the cultural event or at the hours specified by W.S. 12

101(a) if the cultural event extends beyond the hours specified therein.

(g) For purposes of this section
"
cultural event
"
may include but is not limited to, theater productions, concerts, sporting events and rodeos, or any
similar
event as approved by the local licensing authority.

(h)

The permits authorized by this section shall be issued after a hearing on application for a one (1) year period unless sooner revoked and the license fee shall be one thousand five hundred dollars ($1,500.00) payable annually in advance.

Section 2.

This act is effective July 1, 2011.
