Current law prohibits the
disposal, offer for sale or lease of any lots in any town or addition to any
town or city until the lot is platted and the plat is recorded.

●

This act changes the
prohibition to the sale of lots and defines "sale" as it is defined
in the subdivision laws.

●

Under current law failure to
file a plat is punishable by a $50 fine. This act deletes the $50 fine but
provides that the prohibition is enforceable by all appropriate legal remedies
including injunctive relief or writ of mandamus.

Be It Enacted by the Legislature of the State of
Wyoming
:

Section 1.

Selling lots not platted prohibited.

(a)

Any

No
person
who
shall
dispose of, or offer for sale, or lease,

sell, as defined in W.S. 18

(v),
any lots in any town, or addition to any town or city, until the plat thereof has been duly acknowledged and recorded as provided in this act

, shall forfeit and pay fifty dollars ($50.00) for each lot, and part of lot sold, leased or disposed of, or offered for sale.

(b)

he provisions of this
section
are enforceable by all appropriate legal remedies including but not limited to injunctive relief or a writ of mandamus.

Section 2.
This act is effective July 1, 2011.
