Sponsored by: Representative(s) Zwonitzer, Dn., Blake, Kasperik and Petroff and Senator(s) Martin A BILL for AN ACT relating to public health and safety; providing for voluntary certification of tattoo studios as specified; providing for rulemaking; providing a definition; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section 1. W.S. 35 ‑ 4 ‑ 140 is created to read: 35 ‑ 4 ‑ 140. Certification of tattoo studios . (a) The department shall , by rule and regulation, develop a program of voluntary certification of tattoo studios and persons administering tattoos and body art for purposes of preventing the spread of blood borne diseases. (b) Before issuing a certification under this section, the department shall inspect the premises where administration of tattoos or body art is occurring to ensure compliance with rules and regulations of the program. Once a certification is issued, the department may periodically inspect the premises as provided in rule and regulation. (c) Denial, suspension or revocation of any certification shall be in conformance with the Wyoming Administrative Procedure Act. (d) Nothing in this section shall be construed to require licensing or certification , by the department , of tattoo studios or persons administering tattoos or body art. (e) As used in this section, "tattoos" and "body art" mean as defined in W.S. 14 ‑ 3 ‑ 107(c)(i) and (vi). Section 2. W.S. 35 ‑ 1 ‑ 240(a) by creating a new paragraph (xxiii) is amended to read: 35 ‑ 1 ‑ 240. Powers and duties. (a) The department of health, through the state health officer, or under his direction and supervision, through the other employees of the department, shall have and exercise the following powers and duties: (xxiii) To certify tattoo studios as provided in W.S. 35 ‑ 4 ‑ 140. Section 3. The department shall consult with nongovernmental organizations involved in the collection and protection of blood supplies in developing rules pursuant to this act. Section 4 . This act is effective July 1, 2011. (END) 1 HB0238
