WORKING DRAFT 2011 STATE OF WYOMING 11LSO-0345.E1 SENATE FILE NO. SF0051 Safety belt violations. Sponsored by: Senator(s) Scott and Hastert and Representative(s) Davison, Gingery and Harvey A BILL for AN ACT relating to motor vehicles; increasing the fine for failure to use safety belts when required; providing local authority to adopt safety belt exceptions as specified; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section 1. W.S. 31 ‑ 5 ‑ 1402(e) and by creating a new subsection (g) is amended to read: 31 ‑ 5 ‑ 1402. Safety belts required to be used; exceptions; reduction in fine. (e) All citations for violations of the motor vehicle laws of this state and for violations of traffic ordinances or traffic regulations of a local authority shall contain a notation by the issuing officer indicating whether the driver and passengers complied with this section. Compliance with this section shall entitle a licensee to a ten dollar ($10.00) reduction in the fine otherwise imposed by any court having jurisdiction over the alleged offense. The driver who violates this section may be issued a citation and may be subject to a fine of not more than twenty-five dollars ($25.00) seventy-five dollars (75.00) . Any passenger who violates this section may be issued a citation and may be subject to a fine of not more than ten dollars ($10.00). (g) A county, municipal and other local board or body having authority to enact laws relating to traffic may by resolution or ordinance , as applicable , provide exceptions to the safety belt requirement of subsection (a) of this section for persons while riding in parades and other events where vehicles are operated at a continuously slow speed. Section 2 . This act is effective July 1, 2011. (END) 1 SF0051
