AN ACT relating to

chool districts; providing for the
enhanced
teacher e
valuation pilot program as specified; requiring reports; providing an appropriation;
and providing for an effective date.

Be It Enacted by the Legislature of the State of
Wyoming
:

Section 1.

(a)

Two
hundred
ten
thousand dollars ($
21
0,000.00) is appropriated from the general fund to the department of education to be expended for the teacher enhanced evaluation pilot program established and authorized under this section. This appropriation shall be for the period beginning with the effective date of this act and ending Ju
ne 30
, 2012.

(b)

The enhanced
teacher
evaluation pilot program is established under this section to implement an enhanced evaluation process for all teachers in each school
district
participating in the pilot program.

(c)

The state superintenden
t
of public instruction
shall select
four
(
4
) qualified school districts

as provided in subsection (d) of this section
to
participate
in the pilot program as follows:

(i)

One
(
1
) school district
with an average daily membership (ADM) of
more than

four thousand (4,000)
;

(ii)

One
(
1) school district
with an ADM of
more than
one thousand (1,000)
and
four thousand (4,000) or less
;

(iii)

One
(
1
) school district with an ADM of more than
five hundred (500)
and
one thousand (1,000) or less
;

(iv)

One
(
1
) school district with an ADM of
five hundred (500)
or less.

(d)

In selecting school districts under subsection (c) of this section, the state superintendent shall determine if the school district is a qualified school district. In order to be a qualified school district under this subsection, the school district shall:

(i)

Have an organized
and active parent
organization
with elected officers and which meets at least once per month during the school year
;

(ii)

Submit a plan of action to the state superintendent which shall include the following:

(A)

A proposed schedule of teacher evaluations to the state superintendent which at a minimum would provide one (1) evaluation per semester for each teacher in the district;

(B)

A statement detailing the proposed evaluation process which will be implemented by the district. The evaluation process shall at a minimum comply with the requirements of subsection (e) of this
section
;

(C)

A statement detailing the method the district will use to implement the results of evaluations conducted under the pilot program including
recommending
increases in pay for teachers with positive evaluations and implementing termination proceedings if a teacher
receives
three (3)
consecutive
failed evaluations.

(e)

From the amount appropriated under subsection (a) of this section, the state superintendent shall award grants to the school districts selected under subsection (c) of this section. The grants shall be expended by the districts to implement an expanded teacher evaluation process which includes:

(i)

Using
built-in
classroom cameras to record at least one (1) class
period,
unannounced
per semester for each teacher in the district;

(ii)

Evaluation of each recorded class by the school principal, the teacher who is being evaluated,
an instructional facilitator or
a teacher with at least ten (10) years of teaching experience
and
a parent of the school's parent organization
selected by the organization
. Each person evaluating
a recorded class shall complete an evaluation review form which
will be reviewed by the principal and the instructional facilitator or teacher with ten (10) years of experience to determine
recommendations for improvement
,
set
goals
and

timelines
for improvement

or
make
recommendation
s
for performance based pay increase;

(iii)

A
parent selected to participate in evaluating a class shall attend the monthly meeting of the parent organization. The parent group shall report to the school board each month on the evaluations performed that month and the evaluations scheduled for the upcoming month.

(f)

Each district participating in the pilot program under this section shall report to the state superintendent not later than
June 30
, 2012 on the effectiveness of the program. The report may include recommendations for continuing or expanding the pilot program. The state superintendent shall compile the reports submitted under this subsection and report the results to the joint education
interim
committee and the joint appropriations
interim
committee not later than December 1, 2012.

Section 2.

This act is effective July 1, 2011.
