Sponsored by: Senator(s) Jennings and Representative(s) Brechtel A BILL for AN ACT relating to constitutional instruction for specified officials and other persons; requiring the secretary of state to develop specified constitutional instruction; requiring the secretary of state to convene a board to develop constitutional instruction; making the act contingent upon passage of a constitutional amendment as specified; providing an appropriation; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section 1. W.S. 9 ‑ 1 ‑ 308 is created to read: 9 ‑ 1 ‑ 308. Powers and duties; constitutional instruction for elected and other persons. The secretary of s tate shall develop and produce a prerecor ded, audio-visual presentation, no less than three (3) hours in length, which shall teach the fundamental principals of the United States and Wyoming constitutions without interpretation and consistent with the plain meaning of the constitutional language drafted by the founding fathers. The secretary of s tate shall convene a board composed of technical advisors and constitutional scholars with equal major political party representation for the purpose of developing the content of the audio-visual presentation required by this section. The audio-visual presentation shall be completed and distri but ed on or before July 1, 2013 and a copy of the presentation shall be delivered to the g overnor and the l egislature on or before that date. Section 2 . There is appropriat ed sixty-six thousand dollars ($ 66 ,000.00) from the general fund to the s ecretary of s tate. This appropriation shall be expended only for the purpose of costs associated with developing and distributing the constitutional instruction required by section 1 of this act and for costs associated with implementing the constitutional instruction mandated by the constitutional amendment provided in 2011 Senate Joint Resolution 1 . Notwithstanding any other provision of law, this appropriation shall not be transferred or expended for any other purpose and any unexpended, unobligated funds remaining from this appropriation shall revert as provided by law on June 30, 2014 . This appropriation shall not be included in the secretary of state's annual 2013-2014 standard biennial budget request. Section 3. This act is effective only if Wyoming electors adopt the constitutional amendment provided in 2011 Senate Joint Resolution 1 at the 2012 general election . Section 4. Subject to section 3 of this act, this act is effective upon certification of the election results of the 2012 general election. (END) 1 SF0141
