ing

uthority; providing for review by the legislature of alternative tolling plans
and alternative means of paying tolls for Wyoming licensed vehicles
; and providing for an effective date.

101.

Purpose
.

In order to finance, construct, operate and maintain
I
nterstate 80 and accommodate the needs of the traveling public through safe, efficient, convenient and modern vehicular traffic, it is necessary and in the public interest for the state to apply for the authority to toll
I
nterstate 80 and to develop tolling configuration plans for
submittal to and consideration by the legislature.

For this purpose, it is necessary to authorize the
Wyoming
transportation commission to create and supervise a tolling program within the department of transportation
as approved by the legislature
.

Definitions
.

(a)

As used in this article:

(i
)

"Interstate 80" means the entire length of
Interstate 80
in Wyoming, or as specifically designated in the project master plan;

(i
i)

"Project" means an existing highway or additional lane capacity that is part of
Interstate 80
and related highway improvements, maintenance and services and all matters related to the imposition and collection
of tolls on
Interstate 80
;

(
iii
)

"Project master plan" means a comprehensive plan for the project as required by this article and which shall be presented to the legislature for approval;

(iv
)

"Toll" means compensation paid for the use of
Interstate 80
, or any part thereof, by vehicular or other traffic.

Authority
.

The
transportation
commission and department
of transportation
have authority to obtain permission from the
United States
to impose tolls on
Interstate 80
and to develop a project master plan for submittal to and consideration by the legislature.

Statewide tolling program creation.

The director
of the department of transportation
with the approval of the
transportation
commission
shall

develop
the project, obtain approval from the
United States
to toll
Interstate 80
and submit the project
master
plan to the legislature for consideration.

Toll highway project master plan; review.

(a)

The department
of transportation
shall develop a project master plan for the project that describes, but is not limited to:

(i)

The tolling approach and toll rate structure;

(ii)

The operations and maintenance plans;

(iii)

The toll revenue projections and financial plans;

(iv)

Funding source alternatives from which to finance tolling fees for vehicles registered in
Wyoming
;

(v
)

Any other federally required information.

(b)

The project master plan shall present all reasonable and feasible options for the operation or development of the project where such options are available
and identify all reasonable and feasible funding source alternatives from which to finance tolling fees for vehicles registered in
Wyoming
.

(c)

Upon completion, the project master plan shall be presented to the
transportation
commission. If the project master plan is approved by the commission it then shall be submitted to the legislature for consideration.

Section 2.

This act is effective immediately upon co
m
pletion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constit

tion.
