WORKING DRAFT 2011 STATE OF WYOMING 11LSO-0467 SENATE FILE NO. SF0153 Health education and law enforcement prevention grants. Sponsored by: Senator(s) Hastert and Nutting and Representative(s) Barbuto A BILL for AN ACT relating to health education by law enforcement ; creating an account; providing for the expenditure of funds from the account for preventive education training by law enforcement ; providing an appropriation; providing rulemaking authority ; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section 1 . (a) There is created the health education and law enforcement prevention grant account which shall be funded for the benefit of the department of health, mental heath and substance abuse division . (b) The health education and law enforcement prevention grant account shall be funded through the appropriation made in Section 2 of this act as well as any monies received from federal grants and other contributions, grants, gifts, transfers, bequests and donations to the account. The account is specifically empowered to accept grants, gifts, transfers, bequests and donations including those which are limited in their purposes by the grantor. (c ) All monies in the health education and law enforcement prevention grant account are continuously appropriated to the department of health and shall be expended only to provide grants and other funding to law enforcement agencies that provide prevention education related to: (i) Bullying, cyberbullying and internet safety; (ii) Prescription, over-the-counter and other drug abuse s and addictions ; (iii) Decision making and positive , healthy choices . (d) The department shall identify and select persons to whom they will provide funding from the health education and law enforcement prevention grant account based on the following criteria: (i) Consideration of the number of people served; (ii) The availa bility of other funding sources; (iii) The effectiveness of the services offered in providing the prevention education identified in subsection (c) of this section. ( e ) The department of health, mental health and substance abuse division shall promulgate reasonable rules and regulations in accordance with the Wyoming Administrative Procedure Act to implement the award of funds in the health education and law enforcement prevention grant account and to review and monitor the expenditure of monies awarded . Section 2. There is appropriated one hundred thousand dollars ($100,000.00) from the gene ral fu nd to the department of health, mental heath and substance abuse division. This appropriation shall be for the period beginning with the effective date of this act and ending June 30, 2012. This appropriation shall be deposited in the health education and law enforcement prevention grant account, created by Section 1 of this act, and shall only be expended for the purposes outlined in Section 1 of this act. Notwithstanding any other provision of law, this appropriation shall not be transferred or expended for any other purpose and any unexpended, unobligated funds remaining from this appropriation shall revert as provided by law on June 30, 2012. This appropriation shall not be included in the department of health's standard 2013-2014 budget. Section 3 . The department of health, mental heath and substance abuse division shall provide a report to the joint labor, health and social services interim committe e no later than November 1, 2012 with respect to the expenditure of the appropriation provided by this act . The report shall identify the persons or programs who received funds from the health education and law enforcement prevention grant account and the amounts received. The report also shall describe the types of education that were funded and identify who received the education. The report shall include any other information deemed relieving by the department. Section 4 . This act is effective immediately upon co m pletion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constit u tion. (END) 1 SF0153
