Summary/Major Elements: This resolution proposes to amend the Wyoming Constitution to provide that: o Each competent adult has the right to make his or her own health care decisions; o Any person may pay directly for health care without penalties or fines; o The legislature may prescribe reasonable and necessary restrictions on the right to health care access; o The state shall act to preserve the right to health care access from undue governmental infringement. Comments: This resolution, if approved by the voters, would create a new Article 1, Section 38 in the Wyoming Constitution.
WORKING DRAFT ORIGINAL SENATE JOINT RESOLUTION NO. 0002 ENROLLED JOINT RESOLUTION NO. 2, SENATE SIXTY-FIRST LEGISLATURE OF THE STATE OF WYOMING 2011 GENERAL SESSION A JOINT RESOLUTION proposing to amend the Wyoming Constitution by creating a new section providing that the right to make health care decisions is reserved to the citizens of the state of Wyoming, providing for direct payments to health care providers, allowing the legislature to establish restrictions and requiring the state of Wyoming to protect health care rights from undue governmental infringement . BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF WYOMING , two-thirds of all the members of the two houses, voting separately, concurring therein: Section 1. The following proposal to amend Wyoming Constitution, Article 1 , by creating a new Section 38 is proposed for submission to the electors of the State of Wyoming at the next general election for approval or rejection to become valid as a part of the Constitution if ratified by a majority of the electors at the election: Article 1 , Section 38 . Right of health care access. (a) Each competent adult shall have the right to make his or her own health care decisions. The parent, guardian or legal representative of any other natural person shall have the right to make health care decisions for that person . (b) Any person may pay, and a health care provider may accept, direct payment for health care without imposition of penalties or fines for doing so . (c) The legislature may determine reasonable and necessary restrictions on the rights granted under this section to protect the health and general welfare of the people or to accomplish the other purposes set forth in the Wyoming Constitution . (d) The state of Wyoming shall act to preserve these rights from undue governmental infringement . Section 2. That the Secretary of State shall endorse the following statement on the proposed amendment: The adoption of this amendment will provide that the right to make health care decisions is reserved to the citizens of the state of Wyoming . It permits any person to pay and any health care provider to receive direct payment for services. The amendment permits the legislature to place reasonable and necessary restrictions on health care consistent with the purposes of the Wyoming Constitution and provides that this state shall act to preserve these rights from undue governmental infringement.
