Subject: Awards costs for independent appraisals in private road actions under specified circumstances. Summary/Major Elements: Under Wyoming's private road statutes, the damages and costs available to the person owning the land over which the private road will run (the "affected party") do not include the costs of an independent appraisal which reveals damages different than those determined by the statutorily appointed viewers and appraisers. Under this bill, a private road applicant will be responsible for paying the costs of an appraisal obtained by the affected party if the appraisal is adopted in substantial part as a basis for damages and varies more than 15% from the viewers and appraisers' damage calculation.
WORKING DRAFT ORIGINAL HOUSE BILL NO. 0052 ENROLLED ACT NO. 7, HOUSE OF REPRESENTATIVES SIXTY-FIRST LEGISLATURE OF THE STATE OF WYOMING 2012 BUDGET SESSION AN ACT relating to the establishment of private roads; permitting the recovery of appraisal costs as specified; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1. W.S. 24 ‑ 9 ‑ 103 by creating a new subsection (f) is amended to read: 24 ‑ 9 ‑ 103. Report of viewers and appraisers; second hearing; order by commissioners; appeal. (f) In addition to paying other damages and costs required by this section and by W.S. 24 ‑ 9 ‑ 101, the applicant shall be responsible for paying the reasonable costs of an appraisal obtained by an affected party if that appraisal was adopted in substantial part as a basis for damages and varied more than fifteen percent (15%) from the valuation determined by the viewers and appraisers appointed under W.S. 24 ‑ 9 ‑ 101(h). Section 2. This act is effective July 1, 201 2 .
