WORKING DRAFT 2012 STATE OF WYOMING 12LSO-0130 HOUSE BILL NO. HB0059 Insurance adjusters. Sponsored by: Representative(s) Illoway and Blikre and Senator(s) Case A BILL for AN ACT relating to insurance; providing for licensure of Canadian adjusters; providing an exception from licensure for persons collecting insurance claim information as specified; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1. W.S. 26 ‑ 9 ‑ 219(b)(ii), (e) and by creating new subsections (f) through (h) is amended to read: 26 ‑ 9 ‑ 219. Adjuster ' s license; exception; notification. (b) To be licensed as an adjuster the applicant shall: (ii) Except as provided in subsection (f) or (g) of this section, b e a resident of Wyoming or of another state which permits residents of Wyoming to act as adjusters in that state; (e) For purposes of this section, " home state " means the District of Columbia and any state or territory of the United States in which an adjuster maintains his principal place of residence or business and is licensed to act as a resident adjuster , or, if the resident state does not license adjusters, or if adjuster resides in Canada, the adjuster shall designate as his home state any state in which the adjuster is licensed and in good standing . (f) A resident of Canada may be licensed as an adjuster and may designate Wyoming as his home state if the person has successfully passed the adjuster examination and has complied with all other applicable provisions of this s ection. (g) A resident of Canada may be licensed as a nonresident adjuster if he has been granted a resident or home state license from another state with licensure requirements similar to the requirements of the state of Wyoming as determined by the c ommissioner. (h) This section shall not apply to an individual who collects claim information from, or furnishes claim information to, insureds or claimants, and who conducts data entry , including entering data into an automated claims adjudication system, provided that no more than twenty-five ( 25 ) such persons are under the supervision of one (1) licensed adjuster or licensed agent who is exemp t from licensure pursuant to W. S. 26 ‑ 1 ‑ 102(a)(i). For purposes of this section, " a utomated claims adjudication system " means a preprogrammed computer system designed for the collection, data entry, calculation and final resolution of property insurance claims which: (i) M ay only be utilized by a licensed adjuster, licensed agent or supervised individuals operating pursuant to this subsection; (ii) Shall comply with all claims payment requirements of this title; and (iii) Shall be certified as compliant with this sub section by a licensed independent adjuster who is an officer of the entity which employs the individuals operating pursuant to this subs ection.
